As we drive down our Texas highways we are constantly bombarded with slogans, advertisements, and warnings decorating the highway about Texas DWI. My favorite one which is now a 'public message' that comes on in between the commercial on television is "Drink, Drive, Go to Jail." This slogan is everywhere. It is also not the law. The law is if you are driving while intoxicated (DWI).
Intoxicated is defined as losing the normal use of your mental or physical faculties and/or having a blood alcohol concentration of .08 or more. So if you drink then drive and are not intoxicated, you are not violating the law. If you are drinking and driving at the same time then that is a violation of the law. That violation is having an open container and it is a class C misdemeanor.
Nonetheless, be careful of what the state's slogan is versus of what the statutes actually prohibit. Educating yourself about Texas DWI laws is the best way to prevent a DWI charge.
